1. About these terms
These terms govern your organisation’s use of the PathWay platform and website. By creating an organisation or using the platform, you agree to these terms on behalf of your organisation.
2. Accounts and access
The owner account is responsible for the organisation’s workspace, including inviting users and assigning roles. You must keep login details secure and tell us promptly about any unauthorised access.
3. Subscriptions, trials and payment
- New organisations receive a 30-day free trial. No payment details are needed to start.
- Subscriptions are billed monthly or annually in advance, in pounds sterling, plus VAT where applicable.
- Plan limits (such as active learners) apply as shown on our pricing page. You may upgrade or downgrade at any time; changes are pro-rated.
4. Acceptable use
You must not use the platform to break the law, upload harmful content, attempt to access other organisations’ data, or interfere with the service’s security or performance.
5. Your data
Your organisation remains the controller of learner data you add to the platform, and PathWay acts as processor. Our privacy policy and data processing terms explain how we handle personal data.
6. AI learning coach
The AI learning coach provides guided practice and may occasionally produce inaccurate information. It is not a substitute for professional advice. Facilitators should support learners in using it appropriately.
7. Intellectual property
PathWay owns the platform and its content. You keep ownership of your organisation’s branding and the content you upload, and grant us a licence to host and display it to provide the service.
8. Liability
Nothing in these terms limits liability that cannot be limited by law. Otherwise, our total liability in any 12-month period is limited to the fees paid by your organisation in that period.
9. Ending your subscription
You may cancel at any time, effective at the end of your current billing period. On request, we will export your organisation’s data before deleting it within 90 days of cancellation.
10. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
